上海国际经济贸易仲裁委员会（上海国际仲裁中心）新版仲裁规则、特别仲裁规则和程序指引启用公告

经上海国际仲裁中心第四届委员会第五次会议审议通过，《上海国际经济贸易仲裁委员会（上海国际仲裁中心）仲裁规则》2024版仲裁规则已于2024年1月1日起施行，同时施行的还有《上海国际经济贸易仲裁委员会（上海国际仲裁中心）航空仲裁规则》《上海国际经济贸易仲裁委员会（上海国际仲裁中心）数据仲裁规则》《上海国际经济贸易仲裁委员会（上海国际仲裁中心）在线仲裁指引》和《上海国际经济贸易仲裁委员会（上海国际仲裁中心）临时仲裁协助服务指引》。

2024版仲裁规则施行前上海国际仲裁中心受理的案件，仍适用受理案件时适用的仲裁规则。除非当事人在仲裁协议中明确约定适用或者在仲裁程序中同意适用，2024版仲裁规则施行前上海国际仲裁中心施行的仲裁规则，不再适用于上海国际仲裁中心2024年1月1日起受理的案件。

The 2024 SHIAC Arbitration Rules, Special Arbitration Rules and Procedural Guidance Come Into Force

After deliberation and approval of the Fifth Session of the Fourth Committee of Shanghai International Economic and Trade Arbitration Commission (Shanghai International Arbitration Center, “SHIAC”) ,the 2024 SHIAC Arbitration Rules, SHIAC Aviation Arbitration Rules, SHIAC Data Arbitration Rules, SHIAC Guidance for Online Arbitration and SHIAC Guidance for Services for Ad Hoc Arbitration come into force on January 1, 2024.

For cases accepted by SHIAC before the 2024 SHIAC Arbitration Rules become effective, the arbitration rules effective at the time of acceptance shall apply. Unless the parties have expressly agreed to apply them in the arbitration agreement or have decided to use them in the arbitration proceedings, the arbitration rules of SHIAC before the enforcement of the 2024 SHIAC Arbitration Rules shall not be applied to the cases accepted by SHIAC as from January 1, 2024.
